Terms of Service

1. Agreement to Terms

By accessing and using the services of Beautiful Images By April ("we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the terms of this agreement, you are not authorized to use or access our services.

2. Services Provided

Beautiful Images By April provides professional photography services including:

• Professional headshots and portraits
• Event photography (corporate events, conferences, celebrations)
• Business branding photography
• Google My Business photography
• Location-specific services in Sarasota and Bradenton, Florida

3. Booking and Payment

3.1 Session Booking

• A session is considered booked only when a deposit has been received
• Session dates and times are reserved exclusively for you upon booking confirmation
• We recommend booking at least 2-4 weeks in advance for regular sessions

3.2 Payment Terms

• A non-refundable deposit of 50% is required to secure your session date
• The remaining balance is due on or before the session date
• We accept credit cards, debit cards, and electronic transfers
• All prices are in USD and subject to applicable taxes

4. Cancellation and Rescheduling

4.1 Client Cancellation

• Cancellations made more than 14 days before the session: Full refund minus deposit
• Cancellations made 7-14 days before the session: 50% refund
• Cancellations made less than 7 days before the session: No refund
• Deposits are non-refundable in all circumstances

4.2 Rescheduling

• One free reschedule is allowed with at least 7 days notice
• Additional reschedules may incur a $50 rescheduling fee
• Rescheduling must be done within 90 days of original session date

4.3 Weather Cancellations

• For outdoor sessions, we will reschedule at no charge if weather is unsuitable
• Weather determinations are made by the photographer

5. Copyright and Usage Rights

5.1 Photographer's Copyright

Beautiful Images By April retains full copyright ownership of all photographs taken. This includes the right to use the photographs for:

• Portfolio and website display
• Marketing and promotional materials
• Social media posts
• Competitions and publications

5.2 Client Usage Rights

Upon full payment, clients receive:

• Personal use license for all delivered images
• Right to print images for personal use
• Right to share on personal social media with photographer credit
• Commercial usage requires separate written agreement and licensing

5.3 Restrictions

• Images may not be altered, cropped, or edited without permission
• Images may not be used for commercial purposes without licensing
• Images may not be sold or transferred to third parties
• Photographer credit must be given when images are shared publicly

6. Image Delivery and Editing

6.1 Delivery Timeline

• Edited images will be delivered within 2-3 weeks of the session date
• Rush delivery available for an additional fee
• Images are delivered via online gallery download

6.2 Editing Style

• All images are professionally edited in our signature style
• Basic retouching is included (skin smoothing, color correction)
• Extensive retouching available for additional fee
• We do not provide RAW or unedited images

6.3 Number of Images

• The number of delivered images depends on your session package
• We deliver our best work and professionally curated selections
• Additional images may be purchased separately

7. Model Release

By booking a session with Beautiful Images By April, you grant permission for the photographer to use the photographs for promotional purposes unless you specifically opt out in writing. If you wish your images to remain private, please notify us in writing before your session.

8. Limitation of Liability

8.1 Equipment Failure

While we use professional backup equipment and take precautions, in the unlikely event of complete equipment failure or data loss:

• Our liability is limited to a refund of amounts paid
• We will offer a complimentary reshoot when possible
• We are not liable for any consequential damages

8.2 Force Majeure

We are not responsible for failure to perform services due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, illness, or family emergencies.

9. Client Responsibilities

Clients agree to:

• Arrive on time for scheduled sessions
• Follow photographer's guidance during the session
• Ensure all participants (especially minors) have appropriate consent
• Provide accurate contact information and session details
• Obtain necessary permits for location shoots when applicable
• Respect the photographer's creative vision and expertise

10. Conduct and Behavior

We maintain a professional and respectful environment. We reserve the right to terminate a session without refund if:

• Client is abusive, threatening, or harassing
• Client appears under the influence of drugs or alcohol
• Client refuses to follow safety guidelines
• Client engages in illegal activities during the session

11. Privacy and Data Protection

Your personal information and images are handled in accordance with our Privacy Policy. We take data protection seriously and implement appropriate security measures.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
